Procurement Summary

The purpose of this procurement is to install three ductless mini-split systems to condition three separate spaces within an expanded equipment control tower at Watervliet Arsenal, Watervliet, New York. The procurement of this equipment is part of a larger comprehensive construction contract that will be overseen by the U.S. Army Corps of Engineers- New York District. The units shall need to operate at low ambient temperatures with full capacity for heating capabilities. The units will have to maintain a 75 degree space temperature. Due to space constraints and the fact that these units would be cooling specific spaces internal to a larger mixed low and high bay industrial building that does not have regulated air conditioning, these units are the only viable option that can be procured and installed. The systems will be wall mounted in each specific space in accordance with the designed plans and specifications. Market research was conducted and no domestic manufacturers were submitted that comply with FAR 52-225-11.

Waiver Rationale Summary

Ductless Mini Split System HVAC Units are not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities and of a satisfactory quality. Therefore, it is hereby determined, consistent the FAR 25.202(a)(2) [Nonavailability], that these items are not available.
